Conditions
These Terms and Conditions (“Terms”, “Agreement”) constitute a legally binding agreement between Arouza Techlabs (“Company”, “we”, “us”) and any individual or entity (“Client”, “You”) accessing our services.
By accessing https://www.arouzatechlabs.in, you acknowledge that you have read and agreed to be bound by these Terms.
Legal Capacity & Acceptance
1.1 You confirm that you are at least 18 years of age and competent to contract under the Indian Contract Act, 1872.
1.2 If acting on behalf of an entity, you warrant that you have the legal authority to bind such entity.
1.3 Use of our services constitutes explicit consent under the DPDP Act, 2023 for lawful data processing.
Nature and Scope of Services
2.1 Arouza Techlabs provides professional IT services including Web/App development, AI solutions, Software Testing, and UI/UX design.
- Web & Mobile application development
- Software testing (manual & automation)
- Artificial Intelligence & Machine Learning
- Staffing & resource augmentation
2.2 Services are delivered strictly based on written proposals and Statements of Work (SOW).
Client Obligations
3.1 The Client shall provide accurate information, ensure ownership for shared materials, and provide timely feedback.
Payment Terms
4.1 Payments shall be made strictly as per invoice terms. All fees are exclusive of GST unless specified.
4.2 Failure to pay invoices may result in suspension of services or legal recovery proceedings.
Refund & Cancellation
5.1 General Rule
All payments are non-refundable, as services fall under non-returnable professional services under the Consumer Protection Act, 2019.
5.2 Eligible Scenarios
Refunds are only considered if work has not commenced and requested within 48 hours. Approved refunds are processed within 7–14 business days.
Intellectual Property
6.1 Until full payment, all IP remains with Arouza Techlabs.
6.2 Upon full settlement, ownership transfers to the Client, excluding pre-built frameworks and internal tools.
Confidentiality
7.1 Both parties agree to maintain confidentiality of business strategies and technical data. Breach may result in legal action under the IT Act, 2000.
Data Protection
8.1 Personal data is processed lawfully under the DPDP Act. Users have rights to access, correction, and erasure.
Limitation of Liability
9.1 Maximum liability shall not exceed the fees paid for the specific service provided.
Governing Law
This Agreement is governed by Indian Law. Jurisdiction lies exclusively with courts in India.
